Overview
AccuSource is committed to protect the privacy of our clients, visitors to our website, consumers with respect to whom we perform background screening at our clients' request. As a consumer reporting agency governed by the U.S. federal Fair Credit Reporting Act ("FCRA"), among other applicable laws,
AccuSource endeavors to maintain the confidentiality, integrity, and security of personal information that AccuSource acquires. AccuSource complies with the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland. AccuSource has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. 1. Notice
AccuSource receives personal information about consumers from its clients. AccuSource's clients certify to AccuSource that (i) to the extent required by applicable law; they have obtained the consumer's consent to share this information with AccuSource for purposes of conducting a background screen on the consumer, (ii) they are requesting a background screen for employment or other purposes permitted under the FCRA or other applicable law, and (iii) they will use the results of AccuSource's background screening only for legally permissible purposes, such as hiring, promoting and discharging decisions.
AccuSource conducts background screens only in compliance with the FCRA or other applicable law. Through its background screenings, AccuSource obtains information about consumers, and provides it to its clients, as requested by AccuSource's clients and consistent with the consumer's authorization, The information that is collected about the consumer may include, but may not be limited to, history of arrests and/or convictions, credit history, employment history, educational history, places of residence, and driving records. Pursuant to the terms of its contracts with its client, AccuSource uses this information to prepare a report that meets its clients' requirements.
AccuSource will not use the information collected about a consumer for any other purpose without first giving the consumer an opportunity to opt out from such use. If the information is "sensitive" information as defined in the Safe Harbor Privacy Principles (i.e. personal information specifying medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership or information concerning an individual's sex life), AccuSource will not use the information unless affirmatively authorized by the consumer.
2. Choice
AccuSource collects information about consumers only if AccuSource's client has, to the extent required by applicable law, certified to AccuSource that the consumer has affirmatively authorized such collection. Consumers who do not want AccuSource to collect information about them can choose to prevent collection by refusing to sign the notice and authorization form presented by their prospective or current employer in accordance with the FCRA or, if required, by other applicable law. Consumers who wish to revoke their consent to AccuSource's collection of information about them can do so at any time by sending notification to AccuSource (888) 649-6272 (inside the US and Canada) or (951) 734-8882 or to the contact information for AccuSource listed on the notice and authorization form signed by the consumer.
The revocation does not mean that information already collected will be erased or deleted. Various laws and compliance obligations require that AccuSource maintain the data on file for a period of time. However, the consumer's data will not be further disclosed after AccuSource receives a revocation. After revocation of consent, AccuSource will not use the information for any purpose other than maintaining an internal record of having performed the background check as of such date for compliance reasons.
3. Onward Transfer (Transfers to Third Parties)
AccuSource usually will disclose the information obtained on a consumer only to (i) the AccuSource client who, the consumer has authorized to receive the information (and its designated representatives), and (ii) a third-party representative of subcontractor of AccuSource authorized to receive such information (e.g., service providers that help host or support AccuSource's website, or otherwise provide technical support; court researchers; and other professional services providers). AccuSource shares information with these third parties only for the reasons described in the "Notice" section of this Policy.
AccuSource takes reasonable steps to protect personal information disclosed to its representatives and subcontractors.
AccuSource will disclose only the least amount of personal information necessary to deliver to AccuSource the requested product or service. Before making such disclosures, AccuSource determines that the third-party is subject to the European Union Protection Directive or requires by written agreement that the third-party provide at minimum the same degree of privacy protection as required by the related Safe Harbor Privacy Principles. In addition, AccuSource will disclose consumer information to such third parties if they maintain commercially reasonable security measures to protect the confidentiality, integrity and security of that personal information.
AccuSource may also, in good faith, disclose personal information and any other additional information available to AccuSource, for any of the following purposes: i) to investigate, prevent or take action regarding actual or suspected illegal activities or fraud; situations involving potential threats to the physical safety of any person; or violations of AccuSource's terms of use; (ii) to respond to subpoenas, court orders, or other legal process; (iii) to establish AccuSource's legal rights; or (iv) otherwise to comply with applicable laws.
AccuSource may acquire other business or may be acquired by other businesses. In such circumstances, information collected by AccuSource may be one of the assets examined or transferred as part of the transaction. AccuSource will not permit another business to examine the information collected by AccuSource without a confidentiality agreement and only to the extent permitted by law. AccuSource will not transfer the information it has collected unless the recipient agrees to provide privacy protection equal to or more than those established by this Privacy Policy.
4. Access
AccuSource permits all consumers to inspect, and/or receive a copy of, the information that AccuSource has collected about them in accordance with the FCRA or other applicable law. Consumers may also request that AccuSource correct, amend or delete inaccurate information about them. 5. Security
AccuSource is committed to the protection of the personal information that AccuSource receives about consumers. While the security of such information cannot be guaranteed, we use a blend of online and offline security technologies, procedures and organizational measures to protect consumer information from loss, misuse, and unauthorized access, disclosure, alteration and destruction.
6. Data Integrity
As per the applicable law, AccuSource takes reasonable steps to ensure that the information AccuSource collects is accurate, complete, current and reliable for its intended use. AccuSource cannot be responsible for errors that exist within public records or within records of other consumer reporting agencies, such as the national credit bureaus, and therefore, cannot act as a guarantor of that information. 7. Enforcement
AccuSource conducts in-house verification of its compliance with the Safe Harbor Privacy Principles. European Union consumers who feel that their privacy may have been violated based on the Safe Harbor privacy principles should contact either: AccuSource, Inc. directly, by calling (888) 649-6272 (inside the US and Canada) or (951) 734-8882 or the European Data Protection Authorities directly. AccuSource, Inc. agrees to cooperate with the European Data Protection Authorities in the investigation and resolution of complaints as well as comply with its advice. AccuSource, Inc. has procedures in place for training its employees in its implementation of the Safe Harbor policy and taking corrective action if it is not followed as well as internal procedures for periodically conducting objective reviews of compliance with the above.
Changes to this Privacy Policy
This Privacy Policy may be modified or amended at any time without prior notice. If we revise this Privacy Policy, we will not use or share your information in a manner that is incompatible with the policy in effect when your information was collected without first giving consumers the opportunity to opt out from such use or disclose.
